The state investigators determined the nursing home "failed to ensure a resident had a Physician's order for physical restraints." A resident was observed at 8:30 AM on May 3, 2019, with a "self-releasing seatbelt." A few minutes later, a Certified Nursing Assistant (CNA) verified there was a self-releasing seatbelt in the resident's wheelchair.

The CNA indicated that "the self-releasing seatbelt was used to ensure the resident was safely seated in the wheelchair and would not fall from the chair. The CNA indicated [that the resident], when outside smoking, used a self-releasing seatbelt in the afternoon."

The surveyors reviewed the resident's medical records that lacked "documented evidence of a Physician's order for the use of [the restraint]." A Licensed Practical Nurse (LPN) indicated that the resident "did not have a new Physician's order to have a self-releasing seatbelt."

The Director of Nursing stated that "a Physician's order was required for a self-releasing seatbelt. The Director verbalized it was considered a physical restraint."

Failure to Timely Report Suspected Abuse, Neglect or Theft and Report the Results of the Investigation to Proper Authorities – citation #F609 date May 3, 2019

The "facility failed to report an injury of unknown origin to the required State Agency." The investigation involved a resident whose Nursing Progress Notes from March 29, 2019, documented "a bruise on the upper left arm" and "will monitor."

A Licensed Practical Nurse (LPN) verified that the resident "had an injury of unknown origin on March 29, 2019 [and said that] the facility's policy was to notify the Physician and monitor the resident."

The LPN indicated that the injury "should have been reported to the Director of Nursing." The resident's Medical Record "lacked documented evidence the incident on March 29, 2019, was reported to the State Agency." The Director of Nursing verified that the incident "had not been reported" to appropriate agencies.
